HP Files Complaint with U.S. International Trade Commission, Seeks to Ban Importation of Memjet-Powered Products

Recycling Times reports that HP Inc. has filed a complaint with the U.S. International Trade Commission (USITC), requesting that the USITC conduct a 337 investigation concerning various Memjet-based inkjet printers, print heads, and ink cartridges.

In August 2015, Memjet filed a patent-enforcement lawsuit in the United States District Court for the Southern District of California, alleging that HP’s PageWide inkjet-printing technology infringed on eight Memjet page-wide inkjet-printing patents. Memjets OEMs its page-wide inkjet printing technology to a variety of manufacturers, including those in the office- and production-printing markets.

According to copies of HP’s complaint that were provided to RT Media, the parent company of Recycling Times, HP accused 25 companies of infringing on six of its U.S. patents – U.S. patents Nos.US6260952B1, US6270201B1, US6491377B1, US7004564B2, US7744202B2, and US7090343B2.

The defendants include:

  • Six of Memjet’s Asia-based manufacturing operations and Memjet’s OEM partnerships.
  • 12 Memjet distributors, as well as other distributors.
  • Seven OEM respondents, as well as other Memjet OEM partnerships.

The document are said to indicate that all “Memjet-powered” inkjet printers, print heads, and ink cartridges are included in the list of accused products.

To stop the accused products from entering into United States, HP is seeking a permanent General Exclusion Order (GEO) and a limited GEO as an alternative.

It’s also requesting permanent cease-and-desist-orders that would prohibit the defendants, their subsidiaries, related companies, and agents from importing, selling, marketing, distributing, or advertising any of the named products within the United States

The USITC is said to be currently reviewing the case.

Justia.com also shows that on May 27, 2016, HP filed a patent-infringement lawsuit against Memjet in the U.S. District Court for the District of Oregon. The named defendants in this lawsuit are Memjet Holdings Ltd., Memjet Home and Office, Inc., Memjet Technology Ltd., Memjet US Services, Inc. and Memjet, Ltd.
